The Government asks the Constitutional Court to suspend the Catalan cannabis law
The Catalan law on cannabis consumer associations has been appealed by the Council of Ministers to the Constitutional Court because it is considered to infringe on the exclusive powers of the State and to provide legal protection and regulate activities classified as crimes in the Penal Code.

This law on Associations of Cannabis Consumers in Catalonia is the result of a Popular Legislative Initiative (ILP) and regulates the transport and cultivation of cannabis by cannabis clubs, in addition to establishing general rules for their constitution, operation and organization.

The government argues that the law cannot be justified by the right of association, nor by consumer protection or the protection of public health. It also maintains that the law ignores the exclusive powers and regulations of the State.
The government is invoking Article 161.2 of the Constitution to have the Constitutional Court provisionally suspend the application of the Catalan law. The same thing happened with the Navarre law regulating cannabis clubs and with the Basque Country's comprehensive addiction and drug dependency care law.
In recent weeks, the Spanish government has appealed three more Catalan laws: the Catalan Social Protection Agency law, the digital wills law, and the law protecting the right to housing. It argues that Catalonia lacks the authority to approve legislation with this content.
